Aquascape Designs Successful in Patent Suit

Aquascape Designs, Inc. announced that it has successfully pursued a patent infringement of the company¹s bog filtration system

In the consent judgment entered by the Federal District Court in Chicago, it was decreed that Stoney Creek Fisheries and Equipment Company and Aspen Valley Landscape Supply, Inc. had infringed U.S. Patent No. 6,740,232, entitled Constructed Wetlands System Treatment Apparatus and Method. The defendant companies will cease the manufacture, use, and offer for sale of a the bog filtration system and related components as described in the Stoney Creek catalog. They further agreed to refrain from all other marketing and promotion of the product. A monetary amount was paid as well.

The decree Judgment marked the settlement of a patent lawsuit brought by Aquascape which claimed that certain products sold by Stoney Creek and Aspen Valley were infringing upon a bog filter patent owned by Aquascape Designs.

“Defense of patents is vital if our industry is to continue to innovate and grow,” said Aquascape Designs president, Greg Wittstock. “Without the protection of patents, there would be little incentive for research and development.”
